Smoking near food could incur £5,000 fine

The same fine could be imposed on the licensees of pubs, clubs and restaurants who fail to make every effort to stop people lighting up.

It will be up to Environmental Health officers to police the law, as the States police made it clear during the consultation process that they would be not be able to divert officers away from other pressing matters.

Deputy police chief Lennie Harper said that although it is routine for police officers to visit licensed premises during the evening, they only envisaged stepping in if there was a public order incident sparked by the ban.

He said: ‘We may have powers under the law, but we will not be involved in enforcing it – we believe Environmental Health will be responsible.

We don’t envisage leaving drug dealers and public order to deal with smokers.’
